1. The Basics

These Terms and Conditions govern your use of cmycubes.com (the Website) and any purchases you make through it. The Website is operated by Orbital Structures Pty Ltd, trading as CMY Cubes.

By browsing, registering, or buying from us, you agree to these Terms. If you don't agree, please stop using the Website.

We may update these Terms from time to time. Changes take effect as soon as they're published. We'll do our best to let you know when something meaningful changes.

2. Creating an Account

To purchase from us, you'll need to create an account. When you do, we'll ask for:

• Your email address

• A mailing address

• A phone number

Everything you provide must be accurate and kept up to date. You're responsible for keeping your login credentials secure. If someone else accesses your account using your details, that's on you.

You cannot use this Website if you are under the legal age to enter a binding contract, or if Australian law prohibits you from receiving these services.

3. Your Responsibilities

When using the Website, you agree to:

• Use it only for lawful purposes

• Keep your password and account details confidential

• Contact us immediately if you suspect unauthorised access to your account

• Not use the Website to send unsolicited emails or to scrape member data

• Not attempt to automate access to the Website or its purchase services

We reserve the right to remove any commercial solicitation, affiliate links, or spam content from the Website at any time, and to terminate accounts that breach these Terms.

4. Buying from Us

When you place an order, you agree to pay the price listed on the Website at the time of purchase. We accept payment via PayPal and Shopify Payments. By using these payment providers, you also agree to their terms of service.

Once your payment is confirmed, we'll send you a receipt. We may also record your purchase details for internal use.

Returns

We will consider a refund on items returned within 1 day of purchase, provided the packaging is unopened and the product is in resaleable condition. Return shipping costs are your responsibility.

Nothing in this clause limits your rights under the Australian Consumer Law.

5. Warranty

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:

• A replacement or refund for a major product failure

• Compensation for any other reasonably foreseeable loss or damage

• A repair or replacement if the product fails to be of acceptable quality (where the failure is not a major one)

You can make a warranty claim within 30 days of purchase. To do so, send us proof of purchase, a description of the product, and the price you paid. Reach us at:

If your warranty claim is accepted, we'll repair or replace the defective product at no cost to you. Shipping costs for the return are your responsibility.

The warranty does not cover cosmetic damage, misuse, abnormal handling, or products that have been altered or modified.

6. Delivery

We use third-party delivery companies to ship your orders. While we select delivery partners carefully, we are not the delivery provider and cannot be held responsible for delays, damage, or loss in transit.

If something goes wrong with your delivery, please:

• Contact the delivery provider directly to request a refund or lodge an insurance claim

• Email us at hello@cmycubes.com to let us know what happened

Your feedback helps us decide whether to continue working with a particular delivery provider.

7. Intellectual Property

Everything on this Website, including text, images, logos, video, audio, and software, is owned by or licensed to Orbital Structures Pty Ltd. It is protected by Australian and international copyright law.

Using the Website does not transfer to you any business name, trademark, domain name, design right, patent, or copyright belonging to us.

You must not reproduce, republish, distribute, or adapt our content without our prior written permission, unless the material is explicitly marked as free to reuse or is in the public domain.

8. Privacy

9. Disclaimers & Limitations

We make every effort to ensure products are accurately shown on the Website. However, colours, sizes, and packaging may vary slightly from what appears on screen.

The Website and all products are provided on an 'as is' basis. To the fullest extent permitted by law, we exclude all implied warranties and conditions not expressly stated in these Terms.

We are not liable for:

• Technical errors, viruses, data loss, or service interruptions

• The accuracy or currency of third-party content on the Website

• Loss arising from e-commerce transactions that fail to complete

• Any unlawful conduct by third parties

Our total liability to you, for any reason, is limited to the most recent purchase price you paid us. Where no purchase was made, our liability is limited to resupplying the relevant information or service.

Nothing in these Terms excludes any guarantee, right, or remedy you are entitled to under the Australian Consumer Law.

10. Termination

These Terms apply for as long as you use the Website.

You can end your relationship with us by:

• Letting us know in writing via the Contact Us link on our homepage

• Closing your account

We may terminate your access if:

• You breach any provision of these Terms

• We are required to do so by law

• A partner providing services to you has ended its relationship with us

• We cease offering services in your region

• Continuing to provide the service is no longer commercially viable for us

We may suspend or cancel your account at any time if your conduct damages our reputation or violates the rights of others. Rights and obligations that accrued before termination survive the end of these Terms.

11. Indemnity

You agree to indemnify and hold harmless Orbital Structures Pty Ltd, its affiliates, employees, agents, and licensors from any claims, liabilities, costs, and damages arising from:

• Content you post through the Website

• Your use of the Website or purchase services

• Any breach of these Terms by you or your agents

12. Dispute Resolution

If a dispute arises from these Terms, neither party may commence legal proceedings until the steps below have been followed (except where urgent relief is required).

Step 1: Notice

The party raising the dispute must give the other party written notice describing the nature of the dispute, the outcome sought, and the action required to resolve it.

Step 2: Negotiation

Within 15 days of that notice, both parties must try to resolve the dispute in good faith through negotiation or another mutually agreed method.

Step 3: Mediation

If the dispute isn't resolved within 7 days of the notice, both parties must agree on a mediator or request one be appointed by the Australian Mediation Association or the Conflict Resolution Service. Mediation costs are shared equally. Each party covers its own legal costs. Mediation will be held in Sydney, Australia.

Step 4: Termination of Mediation

If the dispute remains unresolved after 2 weeks of mediation, either party may ask the mediator to close the process.

All communications during dispute resolution are confidential and treated as 'without prejudice' to the fullest extent permitted by law.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute relating to these Terms will be resolved exclusively in the courts of New South Wales.

14. General

If any part of these Terms is found to be unenforceable, that part is severed and the remainder continues in full force.

Both parties confirm they have had the opportunity to seek independent legal advice and that these Terms are fair and reasonable.

15. SMS & Mobile Messaging

By opting in to our SMS service, you agree to receive recurring text messages from CMY Cubes, including order updates and promotional offers. Message frequency varies. Message and data rates may apply.

To opt out at any time, reply STOP to any message. For help, reply HELP or email hello@cmycubes.com. Opting out of SMS is not a condition of purchase.

We are not responsible for failed, delayed, or misdirected messages. Wireless carriers are not liable for undelivered messages.
